For those working in public sector services that close over this period, that this period of leave (excluding the public holidays) will be covered by way of annual leave. Part VI, clause 5 (viii) of the Nurses and Midwives (Tasmanian State Service) Award states:

Where the employer determines to close offices during the period commencing on Christmas Day and ending on New Year’s Day (or any other days as may be deemed to be publicly observed as these State Service Holidays …) such hours not being Holidays with Pay will be deducted from the employee’s recreation leave accrual.

Similar provisions exist in some Enterprise Agreements covering nurses and midwives who work with Private Sector employers. Please check your Agreement for specifics on this.

For nurses working in General Practices the Nurses Award 2010 at clause 31.9 states:

Where an employer temporarily closes a medical practice, an employee may be directed to take paid annual leave during part or all of this period. Where an employee does not have sufficient accrued annual leave for this period, they may be required to take annual leave in advance.

Again, you will be entitled to payment for public holidays you would have worked during this period.
